Privacy Notice - Private Water Supply Testing

South Hams District Council takes your privacy seriously.

We will use your information in order to facilitate the testing of private water supplies. This notice sets out what we will do with your personal information and who we may share it with in respect of the above.

What information about you do we collect?

We collect the following information:

  • Name
  • Address
  • Email address
  • Telephone number

How do we collect information about you?

Relevant personal data will be collected:

  • From you as the data subject
  • If you are the landlord of a property served by a private water supply, your tenant may provide us with your name and address.
  • If your property is served by the same water supply as a neighbouring property, the occupiers of that property may provide us with your name and address.
  • If you are the landowner where a borehole, spring or well is situated, a resident of a property served by that water supply may provide us with your name and address.

How will your personal data be used?

Your personal data will be used in the following ways:

  • Your personal data will be used to contact you to arrange testing of your private water supply, as required under The Private Water Supply Regulations 2016 as amended.

The Legal basis for processing your data

  • Article 6 1(b) processing is necessary for the compliance with a legal obligation to which the controller is subject. We process this information to meet our legal requirement under The Private Water Supply Regulations 2016 as amended.
  • Article 6 1(e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Who will your personal data be shared with?

The Council is under a duty to protect the public funds it administers, and to this end may use the information you have provided on this form for the prevention and detection of fraud. In this regard it may also share your information with other bodies responsible for auditing or administering public funds for these purposes such as the Police and the Department for Work and Pensions. In addition we also provide information to the Government's Cabinet Office under its National Fraud Initiative. 

The Council is also under a duty to provide information to the Drinking Water Inspectorate for regulatory purposes and it may share data with the Statutory Water Undertaker to protect public health.

The Council will never sell your data to anyone else.

Transferring of data outside the EU

Your data will not be transferred outside the EU. It will be securely stored electronically within the UK only, unless it was necessary for safeguarding or for the prevention and detection of crime.

Length of time we keep your information

The Councils will retain personal data for a minimum period of 6 years from the date of analysis, under the Limitation Act 1980 (Section 2).
