Privacy Notice - Joint Local Plan
South Hams District Council takes your privacy seriously.
We will use your information in order to undertake future consultation and analysis in relation to the Plymouth and South West Devon Joint Local Plan, including the assessment of infrastructure needs. This notice sets out what we will do with your personal information and who we may share it with in respect of the above.

How do we collect information about you?
Relevant personal data will be collected directly via questions accessed through the South Hams website, My Place My Views engagement platform or postal survey.
How will your personal data be used?
Your personal data will be used in the following ways:
- To contact you regarding future planning consultations, only where you have chosen to opt in.
- To inform anonymised public reporting which will act as part of the evidence base for future planning documents and infrastructure bids to Central Government.
- To inform future consultations about your area to improve our strategic planning services focusing on trends and community priorities emerging from this consultation.
The Legal basis for processing your data
Article 6 1 (c) as the processing is necessary for the compliance of a legal obligation to which the controller is subject.
The Councils are legally obligated under the Town and Country Planning Act 1990 to produce a development plan, which this information will feed into.
Article 6 1 (e) as the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Special category data is processed under the following Legal basis:
Article 9 2 (g) as processing is necessary for reasons of substantial public interest, on the basis of domestic law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide suitable and specific measures to safeguard the fundamental rights and the interests of the data subject domestic law.
Relevant substantive public interest conditions include statutory and government purposes, equality and opportunity or treatment, support for individuals with a particular disability or medical condition and safeguarding of economic well-being of certain individuals.
Who will your personal data be shared with?
Your personal information is stored securely and no named individual will be identified in information shared with other services within South Hams District Council and West Devon Borough Council.
Any information used publicly will not identify any named individual and will be grouped for the purpose of reporting at a higher geographical level (for example postcode, ward or lower super output area).
The Council will never sell your data to anyone else.
Transferring of data outside the EU
Your data will not be transferred outside the EU. It will be securely stored electronically within the UK only, unless it was necessary for safeguarding or for the prevention and detection of crime.
Length of time we keep your information
The Council will retain personal data for no longer than six years from the date the plan expires.
