Definitions
- Acceptable Waste: the collection of general refuse and/or paper and cardboard packaging, glass, plastic and mixed boxes and/or any waste that is not Excluded Waste. The Customer’s Duty of Care Waste Transfer Note sets out Acceptable Waste.
- Charges: the charges payable by the Customer for the supply of the Services in accordance with clause 6 (Charges and payment).
- Commencement Date: has the meaning given in clause 2.
- Conditions: these terms and conditions as amended from time to time in accordance with these Conditions.
- Contract: the contract between the Council and the Customer for the supply of Services which includes these Conditions and is in accordance with these Conditions.
- Council: South Hams District Council of Follaton House, Plymouth Road, Totnes TQ9 5NE or any contractor, agent or third party carrying out any part of the Services on behalf of the Contractor.
- Council Fees: a list of standard fees applicable to the Services, which are set out in the Order. The Council reserves the right to amend the Council Fees at any time.
- Contractor: the sub-contractor contracted by the Council from time to time to carry out the Services.
- Customer: the person or firm who purchases Services from the Council.
- Customer Default: has the meaning set out in clause 4.
- Duty of Care Waste Transfer Note: the written record of the waste required under the Environmental Protection Act 1990.
- Excluded Waste: items not included in any trade waste agreement, including but not limited to the following; Hazardous Waste, builders waste, carpet, steel framed windows, soil, charcoal, liquid waste, non-burnable construction material, demolition debris (especially plasterboard or gyproc board), gas cylinders, beer kegs or any other pressure cylinders, petrol, oils, greases, solvents or paints, animal or human remains or waste, acid or caustic substances, clinical, pathological and biological wastes, asbestos substances, tree trunks, electrical goods according to the Waste Electrical and Electronic Equipment (WEEE) Directive including telephones and fluorescent tubes, drugs or poisons, all batteries, motor cycles, motor engines and other major parts of motor vehicles, trailers or similar items.
- Hazardous Waste: waste that contains hazardous properties harmful to human health or the environment as identified on the Environment Agency website.
- Order: The Customer's online order for the Services.
- Prescribed Collection Dates: the collection dates that will be specified by the Council to the Customer following receipt of an Order.
- Services: the collection of trade waste by the Council on the Prescribed Collection Dates.
- Trade Waste: the waste (which is Accepted Waste and not Excluded Waste) produced by the Customer while carrying out its business and commercial activities.
- Trade Waste Containers: the trade waste containers including sacks belonging to the Council that shall be placed at the Customer's property for the purposes of the containing the Trade Waste produced by the Customer until its collection by the Council.
