The Mobile Homes Act 2013 gives the council greater powers to monitor mobile home site licences. These changes don't affect holiday caravan site licences.
On 26 March 2013 the Government passed the Mobile Homes Act 2013 (MHA 2013) which gives greater protection to occupiers of residential caravans and mobile homes. You can find out more about the MHA 2013 on Gov.uk - Park Homes.
Breach of Site Licence Conditions
- The council can serve compliance Notices on site owners where site licence conditions are being breached.
- These notices will set out what the site owner needs to do to correct the breaches, and the timescale for doing so.
- A fee of £48.00 per hour will be charged to serve the Notice.
- Failure to comply with the Notice is a criminal offence.

Fit and Proper Person
From 1 July 2021, site owners operating a relevant Park Home (protected site), holding a site licence, must apply for the relevant person to be included on the register of fit and proper persons. The relevant person could be the site owner or an appointed manager. All site owners will be sent an application pack inviting them to make an application to be included on the register and must apply between 1 July and 30 September 2021. There is a fee of £144.
The following will be considered:
- whether the applicant is competent to manage the site;
- whether the management structure and funding arrangements are suitable;
- whether the applicant has:
- offences relating to fraud, dishonesty, violence, firearms, drugs or any offence listed in Schedule 3 of the Sexual Offences Act 2003
- contravened any provision of the law relation to housing, caravan sites, mobile homes, public health, planning or environmental health or of landlord and tenant law
- contravened any provision of the Equality Act 2010 in, or in connection with, the carrying on of any business
- not harassed any person in, or in connection with, the carrying on of any business
- not been personally insolvent within the past 10 years
- not been disqualified from acting as a company director within the past 10 years
- the right to work in the United Kingdom; and
- a membership of any redress scheme enabling complaints to be dealt with in connection with the management of the site (when this is in place)
Where fit and proper status is granted, the applicant will be included on the register for five years. In some circumstances applications will be granted subject to conditions, which will be determined on the merit of the application.

Register of Site Rules
Existing site rules will eventually be replaced with new site rules to be deposited with the council. Site rules that have already been deposited with us can be viewed below.
There is a fee for the deposit of site rules with the council, which is currently £92.40.

Park Home Register of Site Rules
Battisford Park
Definitions
- Park Home means a mobile home stationed on a pitch and occupied by the Occupier(s) as their only or main residence under the provision of the Mobile Homes Act 1983 and subsequent amendments.
- Park Owner means J B and J Small Park Homes, Victoria House, Victoria Street, Taunton, TA1 3FA
- Park means Battisford Farm Park, Plympton, Plymouth PL7 5AT.
- Pitch means the land, including any garden area, on which an occupier is entitled to station their Park Home under the terms of their Agreement.
- Occupier means the person or persons occupying a Park Home.
Installation, alteration and maintenance of Park Homes and Pitches
- Only Park Homes of proprietary manufacture which comply with the definitions contained in the Caravan Site and Control Development Act 1960 are permitted on the park
- The Supply, delivery, movement and siting of any Park Home must be carried out by a professional contractor with appropriate public liability insurance.
- Wheels must not be removed from the Park Home, nor can the Park Home be repositioned by the Occupier. No external structural alteration or addition to the Park Home or replacement of the Park Home is permitted without the prior written permission of the Park Owner.
- The underneath of each Park Home is to be kept absolutely clear and not used as storage space.
- Trees and plants on a Pitch must not be permitted to grow to a size or shape as to interfere in any way with neighbouring properties. Trees and shrubs must not be removed when a Pitch is vacated.
- Fences are not to be erected without the prior written permission of the Park Owner. Existing fences must be kept in good repair.
- Only one storage shed is permitted on each Pitch. It must be constructed of a non-combustible material and of a size and design approved by the Park owner, with a maximum size of 10 feet by 6 feet, prior to installation and positioned to comply with the relevant conditions of the site licence in force at the relevant time and any requirements of the Local Authority. Any form of fuel storage (being of proprietary type concrete or metal fuel bunker specification) or other structure must be in compliance with all relevant regulations.
- Chimney flues and cowls must be kept in good repair. Care must be taken by Occupiers to prevent the discharge or sparks or excessive smoke.
- Occupiers and their guests must not use or interfere with the fire points provided, for other than the emergency use intended.
- Occupiers are responsible for ensuring that all electrical, solid fuel, oil and gas installations within their Park Home and on their Pitch for which they are responsible comply at all times with the regulatory requirements
- Where water is not separately metered or rated, the use of hosepipes is strictly prohibited, except in the case of fire. Sprinklers are not allowed. The Occupier must not permit mains or waste water to discharge onto the ground nor permit to pass into water closets, gullies or drains any matter that is likely to cause blockage or damage. Occupiers must keep in good repair all pipes and cables for which they are responsible.
- All external water pipes for which the Occupier is responsible shall be lagged against frost by the Occupier who will be responsible for any wastage of water due to the Occupier's failure to do so.
- In order to avoid the risk of damaging or interfering with underground services, no holes or ponds many be dug in the ground.
- Access is forbidden to vacant pitches.
Use of the Park Home and Guests
- The Park Home may only be used by the Occupier and members of their permanent household and invited guests. Occupiers will be held responsible at all times for the behaviour and actions of their guests. The number of persons occupying the Park Home shall not exceed the number of which the Park Home was designed as details in Part 1 of the Agreement.
- Sub-letting of either the whole or part of a Park Home is not permitted.
- Children may not climb trees or banks on the Park, must not be allowed to play around the Park Homes of other Occupiers unless invited to do so, nor must they be allowed to play on roads within the Park.
Rules for Occupiers
- All Occupiers must be 50 years of age or older
- Occupiers must
- Not carry on any trade or business at the Park Home or in the Park
- Not hold any political meeting or sale by auction at the Park Home or in the Park
- Not use the Park Home for any noisy, offensive, illegal or immoral purpose
- Not to do anything at the Park Home which may be or become a nuisance or annoyance, or cause loss, damage or injury to the Park Owner or the Occupiers of any neighbouring properties.
- Not to bring or keep any inflammable, explosive, dangerous or offensive substances or goods onto the Park Home or Park (except fuel in the fuel tank of any private motor vehicle).
- Not to sing or dance or play any musical instrument or equipment for making or reproducing sound or to act in such a manner so as to cause annoyance to Occupiers of any neighbouring property.
- External fires, including incinerators, non-electric or gas barbeques and chimineas are not permitted.
- Everyone using the Park must comply with the regulations of the site licence, fire safety regulations and any other statutory regulations applicable to the Park
- Pets must be kept under proper control. They must not cause noise or nuisance to other residents or be allowed to despoil the Park. Occupiers must not keep any pets or animals except the following:
- One dog per Park Home
- One domestic cat per Park Home
- Animal or pet housed in a cage, aquarium or similar remaining at all times within the Park Home.
- Satellite dishes must be erected discreetly and in a suitable position. No tents or awnings may be erected on the Park.
Rules Relating to Vehicles
- All vehicles must be driven carefully on the Park, not exceeding the displayed speed limit. Parking is not permitted on roads or grass verges. Occupiers and visitors authorised to bring vehicles onto the Park do so at their own risk.
- Vehicles must be parked in authorised parking spaces
- No commercial vehicles are allowed on the Park other than those belonging to tradespeople carrying out work for Occupiers. No commercial vehicles may be left on the Park overnight.
- Trailers, touring caravans, boats and motorhomes are not permitted to be kept on the Park.
- All vehicles must be taxed and insured as required by law and be in running order. Drivers must hold a current, valid driving licence and insurance.
- Disused or unroadworthy or untaxed vehicles must not be left on the Park and the Park Owner reserves the right to remove any abandoned vehicles
- No major repairs to vehicles (entailing immobilisation for more than 24 hours) are permitted on the Park Owner’s land. Motor oils and other fuels of that nature must not be discharged anywhere on the Park.
Crossways Park Homes
Crossways Park Homes Site Rules
- Only one car to each park home.
- Any extra cars should be parked in car parks arranged with park owner’s permission.
- No business to be run from site.
- No walls to be built or stone building of any kind.
- No excess noise or nuisance to other park owners at any time.
- No long stay visitors unless pre-arranged with site owner.
- Every park home must be kept tidy outside
- No wooden sheds; only tin or plastic
- All electric meters to be read quarterly and paid promptly
- Each park owner pays for their own calor gas
- Water bills will be divided equally between each Park homeowner
- Septic tanks when emptied the bill will be divided between each park homeowner.
- No caravans
- No sub-letting
- Each park home pays own council tax
- No dogs unless pre-arranged
- All park homeowners to be middle aged
- No porches or conservatories to be built without planning permission or site owner’s permission.
- No young children allowed on site unless visiting, exempt for the site owner’s family.
- Only rotary washing lines allowed
- No trees or hedges to be planted unless in pots on site
Park owner takes no liability for any loss, injury or accident on site.
Smokey House Park
Smokey House Park Site Rules
In these rules:
- ‘Occupier’ means anyone who occupies a park home, whether under an Agreement to which the Mobile Homes Act 1983 applies, or under a tenancy or any other agreement
- ‘You’ and ‘Your’ refers to the Homeowner or other occupier of a park home
- ‘We’ and ‘Our’ refers to the park owner
These rules are in place to ensure that acceptable standards are maintained on the park, which will be of general benefit to occupiers, and to promote and maintain community cohesion. They form part of the agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983, as amended.
None of these rules is to have retrospective effect. Accordingly:
- They are to apply only from the date on which they take effect, which is 3 February 2015, and
- No occupier who is in occupation on that date will be treated as being in breach due to circumstances which were in existence on that date and which would not have been in breach of the rules in existence before that date.
- These rules also apply for so long as they live on the park to the park owner and any employees except for the following rules: 17, 18, 20 and 27.
Condition of the Pitch
- For reasons of ventilation and safety you must keep the underneath of your home clear and not use it as a storage space
- You must not erect fences or other means of enclosure unless you have obtained our approval in writing (which will not be unreasonably withheld or delayed) as to comply with the park’s site licence conditions and fire safety requirements.
- The occupier must obtain prior written approval for all improvements to their plot (which will not be unreasonably withheld or delayed)
- You must not have external fires, including incinerators. (This rule does not include barbeques)
- You must not keep inflammable substances on the park except in quantities reasonable for domestic use. You must not keep explosive substances on the Park
- Lodgers are not permitted.
- No occupier shall do or permit to be done anywhere on the park any action or act which may be or become a nuisance, damage, annoyance or inconvenience to the park owners or their neighbours or occupiers of any other home on the park or to any adjoining or neighbouring property and shall not use or permit the home to be used for immoral or illegal purposes. Occupiers will be held responsible at all times for the conduct of their children/grandchildren who shall not be permitted to play on or around any public building, on the car parks or roads or in the entrance to the park.
- The planting of trees and shrubs is subject to the park owner’s permission and you will need our prior written approval as to variety and position (which will not be unreasonably withheld or delayed). They must not be permitted to grow to a size or shape so as to interfere with the roadways or boundaries and any neighbours pitch. Existing trees and shrubs may not be cut down, removed or damaged and gardens must be left intact when the occupier vacates the pitch.
- Washing lines are not permitted, however rotary lines are acceptable, but must be positioned reasonably screened from the public view that is approved in writing by the park owner.
- Boundary hedges and fences must not be interfered with by any residents, the hedges and fences will be maintained by the Park Owner.
- No unauthorised entrances to the park will be permitted.
Storage
- You must not have more than one storage shed on the pitch. Where you source the shed yourself the design, standard size of the shed must be approved by us in writing (approval will not be withheld or delayed unreasonably). You must position the shed as to comply with the park’s site licence and fire safety requirements. The footprint of the shed shall not exceed 8 feet by 8 feet.
- You must not have any storage receptacle on the pitch other than the shed in rule 12 and any receptacle for the storage of domestic waste pending collection by the Local Authority.
- You must ensure that any shed or other structure erected in the separation space between park homes is of non-combustible material and positioned so as to comply with the park’s site licence conditions and fire safety requirements. The separation space is the space between your park home and any neighbouring home.
Refuse
Waste is collected by the Local Authority.
- You are responsible for the disposal of all household, recyclable and garden waste in approved containers through the Local Authority service. You must not over fill the containers and must place them in the approved position for the Local Authority collections
- You must not deposit any waste or rubbish other than in Local Authority approved containers on any part of the park (including any individual pitch).
Business Activities
- You must not use the park home, the pitch or the park (or any part of the park) for any business purposes, and you must not use the park home or pitch for the storage of stock, plant, machinery or equipment used or last used for any business purpose. However you are at liberty to work individually from home by carrying out office work of a type which does not create a nuisance to other occupiers and does not involve other staff, other workers, customers or members of the public calling at the park home or the park.
Age of Occupants
- No persons under the age of 50 years may reside in a park home except for the park owner and their family, the park warden and employees.
Noise Nuisance
- You must not use musical instruments, all forms of recorded music players, radios and other similar appliances and motor vehicles so as to cause a nuisance to other occupiers, especially between the hours of 10.30 p.m. and 8 a.m.
Pets
- You must not keep any pets or animals except the following
- Not more than one domestic cat. You must keep any cat under proper control and must not permit it to frighten other users of the park or to despoil the park.
- Not more than 1 cat
- 2 cats, which they already own and may keep for as long as they wish but they shall not be permitted to replace the pet or acquire another. (does not apply to pets owned by the park owner and their family, and the park warden)
- NOTE: The express terms of a homeowner’s agreement contain an undertaking on the part of the homeowner not to allow anything which is or becomes a nuisance, inconvenience or disturbance to other occupiers at the park and this undertaking extends to the behaviour of pets and animals. A similar requirement not to cause a nuisance applies to tenants and again this includes the behaviour of pets and animals.
- NOTE: These rules do not have retrospective effect. If the keeping of the pet complied with previous rules, an occupier will not be treated as in breach which these rules take effect. However, when the pet dies or leaves it can only be replaced if it complies with these rules.
- Nothing in these park rules prevents you from keeping an assistance dog if this is required to support your disability and assistance dogs UK or any successor body has issued you with an identification book or other appropriate evidence.
Water
- Where water is not separately metered at the park home or not separately charged for you must not use hoses, if the Local Authority has enforced a hosepipe ban (except in case of fire). Also where a spring water supply is used precautions of hose pipe bans may be necessary if water levels become low or Local Authorities enforce a hosepipe ban.
- You must only use fire point hoses in case of fire.
- You must protect all external water pipes from potential frost damage.
Vehicles and Parking
- You must drive all vehicles on the park carefully and within the displayed speed limit
- You must not park anywhere except in the one parking space allocated to your home
- You must not park on the road or grass verges.
- Other than for delivering goods and services, you must not park or allow parking of any commercial vehicles of any sort on the park including:
- Light commercial vehicles or light goods vehicles as described in the vehicle taxation legislation and
- Vehicles intended for domestic use but derived from or adapted from such a commercial vehicle (except for commercial vehicles operated by the park owner and their family, the park warden and employees).
- The parking of a touring caravan and motorhome must conform to site licence and fire safety regulations and must be parked in the permitted and allocated spaces on the park.
- You must hold a current driving licence and be insured to drive any vehicle on the park. You must also ensure that any vehicle you drive on the park is taxed in accordance with the requirements of law and is in a roadworthy condition.
- Disused or unroadworthy vehicles must not be kept anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned.
- You must not carry out the following works or repairs on the park:
- Major vehicle repairs involving dismantling of part(s) of the engine
- Works which involve the removal of oils or other fuels.
Weapons
- It is forbidden to carry offensive weapons or other objects likely to give offence on the park. Guns, crossbows or firearms of any kind shall not be used on the park.
External Decoration
- Homeowners must maintain the outside of their park home in a clean or tidy condition. Where the exterior is repainted or recovered homeowners must use reasonable endeavours not to depart from the original exterior colour scheme. All wheels on your park home must not be removed.
- An exterior dusk till dawn light on your park home must remain on at night, to promote subtle lighting around the park. Guidance note: the park owner is able to provide the bulb free of charge if you require or the bulb can be sourced by yourself at your cost if you prefer.
- Upon selling your home there is a 10% commission payable to the park owners for residential homes.
- The occupier must ensure the home, particularly in respect of public liability which is normally covered by their household insurance.
- No CCTV cameras to be installed recording the outside of their plot or any neighbours.
- The storing of logs or solid fuels is not allowed to breach or infringe any fire safety requirements.

Webland Farm Site Rules

- You must not have external fires, including incinerators. Barbeques are permitted.
- You must not keep inflammable substances on the park except in quantities reasonable for domestic use.
- You must not keep explosive substances on the park.
Storage
- You must not have more than one storage shed on the pitch. Where you source the shed yourself the design, standard and size of the shed must be approved by us in writing (approval will not be withheld or delayed unreasonably). You must position the shed so as to comply with the park’s site licence and fire safety requirements. The footprint of the shed shall not exceed 10m2.
- You must not have any storage receptacle on the pitch other than the shed mentioned in rule 6 and any receptacle for the storage of domestic waste pending collection by the Local Authority.
- You must ensure that any shed or other structure erected in the separation space between park homes is of non-combustible construction and positioned so as to comply with the park’s site licence conditions and fire safety requirements. The separation space is the space between your park home and any neighbouring home.
Refuse
- You are responsible for the disposal of all household, recyclable and garden waste in approved containers through the Local Authority service. You must not overfill containers and must place them in the approved position for Local Authority collections. The approved location is adjacent to the disabled parking by the reception office.
- You must not deposit any waste or rubbish other than in Local Authority approved containers on any part of the park (including any individual pitch).
Business Activities
- You must not use the park home, the pitch or the park (or any part of the park) for any business purpose, and you must not use the park home or the pitch for the delivery or storage of stock, plant, machinery or equipment used or last used for any business purpose. However you are at liberty to work individually from home by carrying out any office work of a type which does not create a nuisance to other occupiers and does not involve other staff, other workers, customers or members of the public calling at the park home or the park.
Age of Occupants
- No person under the age of 55 years may reside in a park home except for the park owner and park warden and their families who reside in the park homes with them.
Noise Nuisance
- You must not use musical instruments, all forms of recorded music players, radios and other similar appliances and motor vehicles so as to cause a nuisance to other occupiers, especially between the hours of 10.30 p.m. and 8.00 a.m.
Pets
- You must not keep any pet or animal at the park home or on the pitch except those which are housed in a cage, aquarium or similar and remain at all times within your home.
NOTE: These rules do not have retrospective effect. As keeping of pets complied with the previous rules, an existing occupier will not be treated as being in breach when these rules take effect. In addition, the park owner and family are exempt from the new rules.
Nothing in these Park Rules prevents you from keeping an assistance dog if this is required to support your disability and Assistance Dogs UK or any successor body has issued you with an Identification Book or other appropriate evidence.
Water
- Where water is not separately metered at the park home or not separately charged you must not use hoses, except in case of fire.
- You must only use fire point hoses in case of fire.
- You must protect all external water pipes from potential frost damage.
Vehicles and Parking
- You must drive all vehicles on the park carefully and within the displayed speed limit.
- You must not park more than three vehicles on the park.
- You must not park on the roads or grass verges.
- You must not park anywhere except in the permitted parking spaces
- Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the park, including light commercial or light goods vehicles as described in the vehicle taxation legislation, vehicles intended for domestic use but derived from or adapted from such or adapted from such a commercial vehicle and motorhomes, touring caravans or other vehicles adapted for providing sleeping accommodation.
- You must hold a current driving licence and be insured to drive any vehicle on the park. You must also ensure that any vehicle you drive on the park is taxed in accordance with the requirements of law and is in a roadworthy condition.
- Disused or unroadworthy vehicles must not be kept anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned.
- You must not carry out the following works or repairs on the park:
- Major vehicle repairs involving dismantling of part(s) of the engine
- Works which involve the removal of oil or other fuels.
Weapons
- You must not use or display guns, firearms and offensive weapons (including crossbows) on the park and you may only keep them on the pitch or in your home if you hold the appropriate licence and they are stored securely in accordance with that licence.
External Decoration
- Homeowners must maintain the outside of their park home in a clean and tidy condition. Where the exterior is repainted or recovered homeowners must use reasonable endeavours not to depart from the original exterior colour-scheme.
Outbuildings
- All buildings on site are private. This is primarily because of the inherent dangers such as three phase electricity, inflammable liquids and automatic plant. Therefore, no one is to enter a park building unless accompanied by one of the Webland staff.
